What worked before may not be working now. When circumstances change your child's best interest may change as well. For that reason a court may be inclined to modify your current custody order. However, a court will scrutinize the reasons why a parent would consider altering a child custody arrangement before ordering a change to the current custody order.
Some reasons a court may order modification of visitation or custody include:
- A change in the child's needs
- Relocation by one of the parents
- Domestic violence or abuse of the child; or
- One parent is found to be in clear violation of an existing order
